ممارسة صلاحيات رئيس بلدية بغداد مؤقتاً

CPA/ORD/21, Aug 2003/6 الأمر رقم 21 الصادر عن سلطة الانتلاف المؤقتة ممارسة صلاحيات رئيس بلدية بغداد مؤقتاً بناءً على السلطة المخولة لي بصفتي المدير الإداري لسلطة الائتلاف المؤقتة، وعلى القوانين والأعراف المتبعة في الحرب، وتمشياً مع قرارات مجلس الأمن الدولي ذات الصلة، بما فيها القرار 2003) 1483)، وإشارة إلى أن منصب رئيس بلدية بغداد شاغر حالياً، وانطلاقاً من الإدراك أن القوانين واللوائح التنظيمية العديدة، التي تنظم إدارة مدينة بغداد، تنيط الصلاحيات حصراً برئيس البلدية؛ الأمر الذي يحول دون إدارة أعمال البلدية بكفاءة وفعالية في ظل الظروف الراهنة، وعملاً بالنيابة عن مواطني بغداد والشعب العراقي، أعلن بموجب هذا ما يلي: القسم 1 صلاحيات مؤقتة لنواب رئيس البلدية 1- جميع الصلاحيات الممنوحة حصراً لرئيس بلدية بغداد بموجب أي قانون أو لائحة تنظيمية أو قرار أو مرسوم تناط بموجب هذا الأمر بنواب رئيس بلدية بغداد الثلاثة. 2- لا يجوز ممارسة هذه الصلاحيات إلا بموافقة اثنين من نواب رئيس البلدية الثلاثة على الأقل. السلطة الانتلافية المؤقتة/الأمر رقم 6 ،21 آب/ أغسطس 2003 2 3- يجوز لنواب رئيس البلدية الثلاثة وضع وإصدار إجراءات إدارية داخلية أو أوامر بلدية حسب الاقتضاء لممارسة هذه الصلاحيات المؤقتة. القسم 2 مدة ممارسة هذه الصلاحيات تبقى هذه الصلاحيات المخولة لنواب رئيس البلدية بموجب هذا الأمر سارية المفعول إلى أن يتم شغل منصب رئيس بلدية بغداد بطريقة مشروعة، أو إلى أن يتم تعديل هذا الأمر أو إلغاؤه. القسم 3 الدخول حيز النفاذ يدخل هذا الأمر حيز النفاذ ويصبح ساري المفعول من تاريخ التوقيع عليه. إل . بول بريمير المدير الإداري لسلطة الائتلاف المؤقتة 2003/8/6 2

COALITION PROVISIONAL AUTHORITY ORDER NUMBER 21 INTERIM EXERCISE OF BAGHDAD MAYORAL AUTHORITY Pursuant to my authority as head of the Coalition Provisional Authority (CPA), and under the laws and usages of war, and consistent with relevant U.N. Security Council Resolutions, including Resolution 1483 (2003), Noting that the position of Mayor in the City of Baghdad is currently vacant, Recognizing that numerous laws and regulations governing the management of the City of Baghdad vest powers exclusively in the mayor; and that this thwarts the efficient and effective management of city business under current conditions, Acting on behalf of the citizens of Baghdad and the people of Iraq, I hereby promulgate the following: Section 1 Temporary Authority of Deputy Mayors 1) All authority granted exclusively to the Mayor of Baghdad by any law, regulation, resolution or decree, is hereby vested in the three Deputy Mayors of Baghdad. 2) This authority may not be exercised absent the concurrence of at least two of the three Deputy Mayors. 3) The Deputy Mayors may develop and issue such internal administrative procedures or municipal ordinances as are necessary to implement this temporary authority. Section 2 Duration of Authority The authority extended to the Deputy Mayors by this Order shall remain in effect until such time as the position of Mayor of Baghdad is properly filled, or until this Order is amended or repealed.
