CPA/REG/13 July 2003/06 اللائحة التنظيمية رقم 6 سلطة الائتلاف المؤقتة مجلس الحكم العراقي وفقاً لصلاحياتي كمدير إداري لسلطة الائتلاف المؤقتة، وانسجاماً مع قرارات مجلس الأمن الدولي ذات الصلة، بما فيها القرار 2003) 1483)، وبناءً على قوانين وأعراف الحرب، وانطلاقاً من الإدراك أن مجلس الأمن، كما نصت الفقرة 9 من القرار 1483، يدعم تشكيل إدارة عراقية مؤقتة بوصفها إدارة انتقالية يديرها العراقيون، إلى أن يشكل شعب العراق حكومة تمثله يعترف بها المجتمع الدولي وتضطلع بالمسؤوليات التي تتولاها سلطة الائتلاف المؤقتة، وإذ ألاحظ أن مجلس الحكم اجتمع في 13 تموز / يوليه 2003 وأعلن عن تشكيل المجلس بوصفه الهيئة الرئيسية في الإدارة العراقية المؤقتة المشار إليها في الفقرة 9 من القرار 1483، وإذ أؤكد أن سلطة الائتلاف المؤقتة والمبعوث الخاص للأمين العام للأمم المتحدة قد عملا معاً، وسيواصلان العمل معاً في عملية تعاونية وتشاورية لدعم تشكيل مجلس الحكم وأعماله، كما أنهما رحبا بتشكيل مجلس الحكم في 13 تموز / يوليه 2003، وانطلاقاً من الإدراك أن لمجلس الحكم، تمشياً مع القرار 1483، صلاحيات ومسؤوليات معينة بوصفه ممثل الشعب العراقي، تشمل ضمان تمثيل مصالح الشعب العراقي في الإدارة المؤقتة وفي تحديد وسائل تشكيل حكومة تمثل الشعب العراقي ويعترف بها المجتمع الدولي، وتأكيداً على أن مجلس الحكم وسلطة الائتلاف المؤقتة يتعهدان، كل منهما، تمشياً مع القرار 1483، بالتنسيق مع الممثل الخاص للأمين العام للأمم المتحدة والعمل معاً في عملية تعاونية وتشاورية من أجل مصلحة الشعب العراقي، أعلن بموجب ذلك ما يلي: اللائحة التنظيمية رقم 6 مجلس الحكم العراقي CPA/REG/13 July 2003/06 القسم 1 الاعتراف بمجلس الحكم تعترف سلطة الانتلاف المؤقتة بتشكيل مجلس الحكم بوصفه الهيئة الرئيسية للإدارة العراقية المؤقتة إلى أن يشكل شعب العراق حكومة تمثله يعترف بها المجتمع الدولي، تمشياً مع القرار 1483. القسم 2 العلاقة بين مجلس الحكم وسلطة الانتلاف المؤقتة 1 - عملا بالقرار 1483، يتشاور مجلس الحكم مع سلطة الائتلاف المؤقتة وينسق معها بشأن جميع المسائل المتعلقة بالحكم المؤقت للعراق، بما في ذلك صلاحيات مجلس الحكم. 2 - تمثل هذه اللائحة التنظيمية تعليمات يتعين بموجبها على جميع مسؤولي سلطة الائتلاف المؤقتة أن يستجيبوا بسرعة لكل ما يطلبه مجلس الحكم من خبراء ومساعدة فنية أو غير ذلك من أشكال الدعم والمساعدة. 2 اللائحة التنظيمية رقم 6 مجلس الحكم العراقي CPA/REG/13 July 2003/06 القسم 3 النفاذ تُنفذ هذه اللائحة من تاريخ التوقيع عليها. التوقيع إل. بول بريمير المدير الإداري لسلطة الائتلاف المؤقتة 2003/7/13 3 اللائحة التنظيمية رقم 6 مجلس الحكم العراقي

~=1It1- 2j COALITION PROVISIONAL AUTHORITY REGULATION NUMBER 6 GOVERNING COUNCIL OF IRAQ Pursuant to my authority as Administrator of the Coalition Provisional Authority (CPA), relevant U.N. Security Council resolutions, including Resolution 1483 (2003), and the laws and usages of war, Recognizing that, as stated in paragraph 9 of Resolution 1483, the Security Council supports the formation of an Iraqi interim administration as a transitional administration run by Iraqis, until the people of Iraq establish an internationally recognized, representative government that assumes the responsibilities of the CPA, Noting that on July 13,2003, the Governing Council met and announced its formation as the principal body of the Iraqi interim administration referred to in paragraph 9 of Resolution 1483, Affirming that the CPA and the Special Representative of the UN Secretary General have worked together and will continue to work together in a cooperative and consultative process to support the formation and operation of the Governing Council and welcomed the formation of the Governing Council on July 13,2003, Acknowledging that, consistent with Resolution 1483, the Governing Council has certain authorities and responsibilities as representatives of the Iraqi people, including ensuring that the Iraqi people's interests are represented in both the interim administration and in determining the means of establishing an internationally recognized, representative government, Emphasizing that, consistent with Resolution 1483, the Governing Council and the CP A, each in coordination with the Special Representative of the UN Secretary General, undertake to work together in a cooperative and consultative process for the benefit of the Iraqi people, I hereby promulgate the following: Section 1 Recognition of Governing Council The CPA recognizes the formation of the Governing Council as the principal body of the Iraqi interim administration, pending the establishment of an internationally recognized, representative government by the people of Iraq, consistent with Resolution 1483. CP A/REG/13 July 2003/06 1) 2) Section 2 Relationship between Governing Council and the CPA In accordance with Resolution 1483, the Governing Council and the CPA shall consult and coordinate on all matters involving the temporary governance of Iraq, including the authorities of the Governing Council. All officials of the CPA are hereby instructed promptly to respond to all requests for experts, technical assistance or other support requested by the Governing Council.
