What did the CPA’s orders rest on?

122 of the CPA’s 126 legal texts draw their authority from Security Council resolutions. Existing Iraqi law is mentioned in only 40, often in order to suspend it: 37 texts contain a clause suspending or overriding Iraqi law. It is the economic orders that invoke “international standards”, the WTO and the IMF.

Open question

Where was the wording of the economic orders taken from? Invoking “international standards” does not say which foreign law served as a model. The answer needs comparison with laws outside the archive.

Method, confidence and limits

Texts: every numbered order, regulation and memorandum with an English text in the archive. Theme follows the classification of “The rhythm of governing”.

Patterns: Security Council (Resolution 1483/1511/1546/1500, Security Council); Iraqi law (Law No. … of …, Penal/Civil/Commercial Code, Labor Law, Company Law, Revolutionary Command Council, Criminal Procedure); suspension (is suspended, shall be suspended, notwithstanding any Iraqi law); international standards (international standards/norms/best practices, internationally recognized); human rights and war (International Covenant, Universal Declaration, Geneva/Hague, Convention against Torture); IMF and World Bank; WTO (WTO, GATT, TRIPS); intellectual property (Paris/Berne Convention, WIPO).

Limits: naming a reference does not mean the text was copied from it; automatic matching may catch a passing mention. The matched context is shown for each text in the table.
