إنشاء دائرة تأمين الحدود والسيطرة عليها

CPA/ORD/24 Aug 2003/26 الأمر رقم 26 الصادر عن سلطة الانتلاف المؤقتة إنشاء دائرة تأمين الحدود والسيطرة عليها بناء على السلطات المخولة لي بصفتي المدير الإداري لسلطة الائتلاف المؤقتة، وبموجب القوانين والأعراف المتبعة في حالة الحرب، وتمشيا مع قرارات مجلس الأمن الدولي ذات الصلة، بما في ذلك القرار 2003) 1483)؛ واعترافا بأن سبل السيطرة على الحدود ضرورية لإنشاء عراق حر وآمن؛ واعترافا بأن مهام السيطرة على الحدود كانت تتولاها سابقاً خمس جهات حكومية مختلفة في إطار النظام العراقي السابق، وأن النظام العراقي السابق كان كثيراً ما يستخدم تلك المهام كأدوات لقمع مصالح الجماهير العراقية؛ واعترافا بأن استعادة عمليات عبور الحدود وانتقال الأشخاص والسلع التجارية عبر تلك الحدود ومن العراق وإليه في أسرع وقت ممكن أمر مرغوب؛ واعترافا بضرورة استعادة عمليات عبور الحدود هذه بطريقة تحمي أمن وسلامة الشعب العراقي وأمن وسلامة الآخرين المتواجدين في العراق بصورة قانونية؛ أعلن بموجب هذا ما يلي: القسم 1 إنشاء دائرة تأمين الحدود والسيطرة عليها يتم إنشاء دائرة في وزارة الداخلية العراقية لتأمين الحدود العراقية والسيطرة عليها. سوف تقوم دائرة تأمين الحدود والسيطرة عليها برصد حركة الأشخاص والسلع ومراقبة تنقلاتهم من العراق وإليه وعبر حدوده. سلطة الانتلاف المؤقتة/ الأمر رقم 24/26 أغسطس - آب 2003 CPA/ORD/24 Aug 2003/26 3. تمارس دائرة تأمين الحدود والسيطرة عليها أنشطتها على نحو يتماشى مع اللوائح التنظيمية والأوامر والمذكرات الصادرة عن سلطة الائتلاف المؤقتة ذات الصلة، بما فيها الامر رقم 16 الصادر عن سلطة الائتلاف المؤقتة بخصوص الإجراءات المؤقتة المتبعة لمراقبة الحدود والموانئ والمطارات العراقية. وتمارس دائرة تأمين الحدود والسيطرة عليها أنشطتها على نحو يتماشى أيضا مع كافة القوانين العراقية الخاصة بالهجرة إلى البلاد ومنها والقوانين الخاصة بالجمارك والحجر الصحي، بما في ذلك قانون الجمارك لعام 1984، ما لم يتم تعليق العمل بها تحديداً من جانب سلطة الائتلاف المؤقتة. القسم 2 مسؤوليات دائرة تأمين الحدود والسيطرة عليها 1. تخول بموجب هذا الأمر دائرة تأمين الحدود والسيطرة عليها السلطة الكاملة لتوجيه جميع المهام المتعلقة بتأمين الحدود والسيطرة عليها التي كانت تمارسها من قبل وزارة الخارجية ووزارة المالية ووزارة الداخلية ووزارة الدفاع ومكتب الرئاسة. وتكون لها سلطة السيطرة على مهام العاملين في الأجهزة التالية وتوجيهها: شرطة الحدود وشرطة الجمارك ومفتشو الجمارك ومفتشو الهجرة، والمسؤولون عن حماية مرافق موانئ دخول البلاد على الحدود، والمسئولون عن إجراءات احتجاز الأشخاص وترحيلهم والدوريات الساحلية والمسئولون عن تطبيق إجراءات الهجرة التي تتم في المطارات وعمليات الجمارك وعمليات إصدار جوازات السفر والتفتيش عليها والاطلاع بمهام شؤون الجنسية والشؤون المدنية. تحتفظ وزارة الخارجية بالسلطة المحدودة لإصدار جوازات السفر الدبلوماسية و الرسمية اللازمة للسفرات الرسمية. 2. تُنقل بموجب هذا الأمر إلى دائرة تأمين الحدود والسيطرة عليها جميع المرافق والمعدات والمركبات المستخدمة لتنفيذ المهام المتعلقة بالحدود والتي كانت في الماضي تُنفذ تحت سلطة وزارة الخارجية ووزارة المالية ووزارة الداخلية ووزارة الدفاع ومكتب الرئاسة. ويُنقل كذلك جميع الموظفين التابعين لهذه الجهات وكافة الأموال اللازمة لهم لتأدية هذه المهام أو لدفع مرتبات العاملين. وتحتفظ وزارة الخارجية بالمرافق والمعدات اللازمة لتنفيذ مسؤوليتها المحدودة والمتمثلة في إصدار جوازات السفر الدبلوماسية والرسمية. سلطة الانتلاف المؤقتة/الأمر رقم 24/26 أغسطس - أب 2003 2 CPA/ORD/24 Aug 2003/26 القسم 3 التعاون فيما بين الوزارات والمكاتب الحكومية تتعاون في هذا المجهود وزارة الخارجية ووزارة المالية ووزارة الداخلية ووكالات الدفاع الوطني ومكتب الرئاسة ودائرة تأمين الحدود والسيطرة عليها وجميع الأجهزة الحكومية المعنية الأخرى. ويشمل هذا التعاون تحديد واتخاذ أي إجراءات إدارية لازمة لتنفيذ هذا الأمر بموجب سلطة وتوجيهات سلطة الائتلاف المؤقتة. القسم 4 التعليمات الإدارية جوز لوزير الداخلية المؤقت أن يصدر التعليمات الإدارية اللازمة لتنفيذ أغراض ذا الأمر بموافقة المدير المسئول عن السياسة الداخلية فى سلطة الائتلاف المؤقتة. القسم 5 الدخول حيز النفاذ يصبح هذا الأمر نافذاً اعتبار من تاريخ التوقيع عليه ال. بول بريمير المدير الإداري لسلطة الائتلاف المؤقتة 3 سلطة الانتلاف المؤقتة/الأمر رقم 24/26 أغسطس - آب 2003

COALITION PROVISIONAL AUTHORITY ORDER NUMBER 26 CREATION OF THE DEPARTMENT OF BORDER ENFORCEMENT Pursuant to my authority as Administrator of the Coalition Provisional Authority (CPA), under the laws and usages of war, and consistent with relevant U.N. Security Council resolutions, including Resolution 1483 (2003), Recognizing that border controls are essential to the establishment of a free and safe Iraq, Recognizing that previous border functions were carried out by five different government entities within the former Iraqi regime, and that the former Iraqi regime often used these functions as tools to oppress the interests of the Iraqi public, Recognizing that it is desirable as soon as possible to restore the normal transit and movement of people and commercial goods to and from Iraq, Recognizing that such transit must be restored in a way that protects the security and safety of the Iraqi public people and others lawfully present in Iraq, I hereby promulgate the following: 1) 2) 3) Section 1 Establishment of the Department of Border Enforcement There shall be established the Department of Border Enforcement for Iraq as a department within the Ministry of the Interior. The Department of Border Enforcement will monitor and control the movement of persons and goods to, from, and across the borders of Iraq. The Department of Border Enforcement shall conduct its activities consistent with all applicable CPA Regulations, Orders, and Memoranda, including CPA Order 16 regarding the Temporary Control of the Iraqi Borders, Ports and Airports, and all Iraqi laws regarding immigration, emigration, customs and quarantine, including the Customs Law of 1984, unless specifically suspended by the CPA. CPA/ORD/24 Aug 2003/26 Section 2 Responsibilities of the Department of Border Enforcement 1) Full authority, direction and control over all border-related functions formerly exercised by the Ministry of Foreign Affairs, the Ministry of Finance, the Ministry of Interior, the Ministry of Defense and the Presidential Office, including border police, customs police, customs inspections, immigration inspections, border port of entry facilities protection, detention and deportation, coastal patrol, airport immigrations and customs processing, passport issuance and inspections, and nationality and civil affairs functions, are hereby vested in the Department of Border Enforcement. The Ministry of Foreign Affairs retains the limited authority to issue diplomatic and official passports necessary for official travel. 2) All facilities, equipment, and vehicles engaged in border-related functions that were previously under the authority of the Ministry of Foreign Affairs, the Ministry of Finance, the Ministry of Interior, the Ministry of Defense, or the Presidential Office, all employees thereof, and all related funds for such functions or payroll, are hereby transferred to the Department of Border Enforcement. The Ministry of Foreign Affairs will retain such facilities and equipment as are necessary to accomplish the limited responsibility of issuing diplomatic and official passports. Section 3 Cooperation Among Ministries and Governmental Offices The Ministry of Foreign Affairs, the Ministry of Finance, the Ministry of Interior, national defense agencies, the Presidential Office and the Department of Border Enforcement, and all other relevant organs of government, shall cooperate in this effort, including prescribing, under the authority, direction and control of the CPA, any administrative procedures necessary to carry out this Order. The Ministry of Finance, under the authority, direction and control of the CPA, shall be responsible for developing policy regarding border-related revenue functions. CPA/ORD/24 Aug 2003/26
