CPA/ORD/22 February 2004/61 الأمر رقم 61 الصادر عن سلطة الإئتلاف المؤقتة بتعديل الأمر رقم 45 الصادر عن سلطة الإئتلاف المؤقتة بناء على السلطات المخولة لي بصفتي المدير الإداري لسلطة الائتلاف المؤقتة، وبموجب القوانين والأعراف المتبعة في حالة الحرب، وتمشيا مع قرارات مجلس الأمن الدولي ذات الصلة، بما فيها القرار رقم 1483 والقرار رقم 2003) 1511)؛
وإشارة إلى أن الأمر رقم 45 الصادر عن سلطة الائتلاف المؤقتة يتطلب من المنظمات غير الحكومية القيام بإجراءات التسجيل؛
وإدراكا منا لالتزام سلطة الائتلاف المؤقتة بالعمل على إدارة العراق بطريقة فعالة، وعلى ضمان تحقيق الرفاهية للشعب العراقي؛
وإشارة إلى الحاجة لإيجاد طريقة مركزية لتسجيل المنظمات غير الحكومية، وإلى الحاجة لاتخاذ الإجراءات الكفيلة بتنسيق أنشطتها؛
وإصرارا منا على ضمان أمن الشعب العراقي ومنع سوء استخدام المنظمات غير الحكومية التحقيق أغراض غير قانونية أو أغراض تستهدف الاحتيال؛
وإدراكا منا للحاجة إلى المزيد من الوقت لتفعيل قدرة مكتب مساعدة المنظمات غير الحكومية؛
أعلن بموجب ذلك إصدار ما يلي:

AMENDMENT TO COALITION PROVISIONAL AUTHORITY ORDER
NUMBER 45 (CPA/ORD/25 November 2003/45) Pursuant to my authority as Administrator of the Coalition Provisional Authority (CPA) and under the laws and usages of war, and consistent with relevant U.N. Security Council resolutions, including Resolutions 1483 and 1511(2003), Noting that the requirement to register NGOs was imposed under CPA Order Number 45, Recognizing the CPA's obligation to provide for the effective administration of Iraq, and to ensure the well being of the Iraqi people, Noting the need for a centralized method of registering non-governmental organizations, and the need to take measures to coordinate their activities, Determined to ensure the security of the Iraqi people and prevent the misuse of non- governmental organizations for fraudulent or illegal purposes, Recognizing that additional time is needed to build the capacity of the NGO Assistance Office, I hereby promulgate the following:

1) يُعدّل نص المادة الخامسة (5) من القسم رقم 9 من الأمر رقم 45 الصادر عن سلطة الائتلاف المؤقتة، والمتعلق بتسجيل المنظمات غير الحكومية، وتصبح صياغة النص النهائية على الشكل التالي:

سلطة الائتلاف المؤقتة/الأمر رقم 23/61 فبراير -شباط 2004
CPA/ORD/22 February 2004/61 اتقدم المنظمة غير الحكومية بحلول 1 مايو/آيار، 2004 قائمة بأسماء جميع الموظفين الأجانب العاملين لديها توضح فيها مؤهلاتهم ومسؤولياتهم. ويتم تحديث هذه القائمة عند رفع التقارير الخاصة بأنشطتها إلى مكتب مساعدة المنظمات غير الحكومية. وترفع هذه التقارير أربع مرات في العام، ويُرفع التقرير الأول في اليوم الأول (1) من شهر مايو/آيار 2004، وترفع التقارير التالية بعد ذلك كل ثلاثة أشهر في اليوم الأول من أيام الشهر بعد مرور ثلاثة أشهر على رقع آخر تقرير."
2) يُعدّل نص المادة السابعة (7) من القسم رقم 9 من الأمر رقم 45 الصادر عن سلطة الائتلاف المؤقتة، والمتعلق بتسجيل المنظمات غير الحكومية، وتصبح صياغة النص النهائية على الشكل التالي:
"على جميع المنظمات غير الحكومية التي استهلت عملها في العراق قبل صدور هذا الأمر الامتثال لأحكامه بحلول اليوم الأول (1) من شهر مايو/آيار 2004".
Section 1: Amendment #
1) Coalition Provisional Authority Order Number 45, Section 9, Article 5, on Registering of Nongovernmental Entities is amended to read in its entirety as follows:
"The NGO shall submit a list of all foreign staff stating their qualifications and responsibilities by May 1, 2004. The list shall be updated when the quarterly activity reports are submitted to the Office. Quarterly activity reports shall be due on the first of the month every three months following May 1, 2004."
2) Coalition Provisional Authority Order Number 45, Section 9, Article 7, on Registering of Nongovernmental Entities is amended to read in its entirety as follows:
"All NGOs operating within Iraq prior to this Order shall comply with its provisions by May 1, 2004." CPA/ORD/22 February 2004/61
