وإشارة إلى التزام سلطة الائتلاف المؤقتة باستعادة النظام والحفاظ عليه ، وإلى حقها المكفول باتخاذ التدابير اللازمة لضمان أمنها وحفظ النظام العام؛
إذ تراودها مشاعر القلق من محاولات تقوم بها بعض الجماعات والأفراد لتقويض جهود الائتلاف، تسعى إلى إيجاد الظروف التي دعا إليها قرار مجلس الأمن الدولي رقم 1483 (2003)، وهي ظروف من شأنها تمكين الشعب العراقي من تقرير مستقبله السياسي بحرية؛
وإصراراً منا على مساعدة الشعب العراقي في تشكيل حكومة تمثل مواطني العراق ويعترف بها المجتمع الدولي من خلال إيجاد بيئة يمكن فيها تأسيس مؤسسات ديمقراطية وحماية الحريات الشخصية، واحترام أحكام القانون وتنفيذها؛
أعلن بموجب ذلك إصدار ما يلي:

COALITION PROVISIONAL AUTHORITY ORDER NUMBER 62
DISQUALIFICATION FROM PUBLIC OFFICE
Pursuant to my authority as Administrator of the Coalition Provisional Authority (CPA), and under the laws and usages of war, and consistent with relevant U.N. Security Council resolutions, including Resolutions 1483 and 1511 (2003), Noting the obligation of the CPA to restore and maintain order and the right of the CPA to take measures for its security and public order, Concerned that groups and individuals are attempting to undermine Coalition efforts, as called for in U.N. Security Council Resolution 1483 (2003), to create conditions in which the Iraqi people can freely determine their own political future, Determined to assist the Iraqi people in establishing an internationally recognized, representative government by creating an environment in which democratic institutions can be formed, personal liberties can be safeguarded, and the rule of law is respected and can be enforced;
I hereby promulgate the following:
القسم 1: سلطة الحرمان من الترشيح #
1) في الحالات التي تقتضيها الاعتبارات الأمنية والحفاظ على النظام العام في العراق، يجوز للمدير الإداري لسلطة الائتلاف المؤقتة أن يقرر تجريد شخص ما من أهليته للمشاركة في انتخابات كأحد المرشحين لتولي منصب عام على أي مستوى من المستويات، أو لقبول ترشيح آخرين له لتولي هذا المنصب، أو للاستمرار في شغل منصب عام، إذا كان هذا الفرد:
أ) ضالعاً في أعمال العنف ضد قوات التحالف أو ضد العاملين في سلطة الائتلاف المؤقتة أو إذا كان قد أمر بتنفيذها أو حرض علناً عليها؛
ب) كان في السابق عضوا كامل العضوية في حزب البعث يحمل مرتبة عضو قطري أو عضو فرع أو عضو شعبة أو عضو فرقة، كما قررت اللجنة الوطنية العليا لحل حزب البعث؛
ج ) عميلاً لدولة أجنبية؛
د ) قد أدين بارتكاب جريمة خطيرة؛

CPA/ORD/26 February 2004/62 ) يشك في انه ارتكب جرائم حرب او جرائم قتل جماعي او جرائم ضد الإنسانية ا نائع أو انتهاكات لحقوق الإنسان، أو شارك فيها أو أمر بتنفيذها أو سمح بوقوعها و ) يعتنق علناً مذاهب سياسية أو عقائد قانونية تناقض إقامة النظام الديمقراطي وتطبيق أحكام القانون في العراق.
2) بجوز للمدير الإداري لسلطة الائتلاف المؤقتة أن يتخذ الإجراءات التي يرى أنها ضرورية لإخطار الفرد المعني بإجراءات اعتباره غير مؤهل للترشيح بموجب ما ينص عليه هذا القسم، ويجوز له كذلك اتخاذ ما يلزم من إجراءات لضمان الحيلولة دون ترشيح الفرد الذي سُحبت منه أهليته للترشيح أو دون استمراره في وظيفته تم منعه من الاستمرار في تولي المناصب العامة أو المطالبة بتوليها. وينبغي على المدير الإداري لسلطة الائتلاف المؤقتة إبلاغ العامة بقراراته والأسس التي اعتمد عليها في اتخاذ هذه القرارات، وذلك بقدر المستطاع من الناحية العملية، وبما يتماشى مع سلطات ومسئوليات سلطة الائتلاف المؤقتة.
Section 1: Authority to Disqualify #
1) When determined necessary for security and public order within Iraq, the Administrator of the CPA may disqualify an individual from participating in an election as a candidate for, accepting a nomination to, or holding public office, at any level, if that individual:
a) Has engaged in, ordered, or publicly incited violence against Coalition Forces or CPA personnel;
b) Was a full member of the Ba'ath Party holding the rank of 'Udw Qutriyya (Regional Command Member), 'Udw Far'(Branch Member), 'Udw Shu'bah (Section Member), or 'Udw Firqah (Group Member), as determined by the Higher National De- Baathification Commission;
c) Is an agent of a foreign government;
d) Has been convicted of a serious offense;
e) Is reasonably suspected of having committed, participated in, ordered, or permitted war crimes, genocide, crimes against humanity, atrocities, or gross violations of human rights; or CPA/ORD/26 Feb 2004/62
f) Has publicly espoused political philosophies or legal doctrines contrary to the democratic order and rule of law being established in Iraq.
2) The Administrator may take such actions as he deems necessary to notify the individual concerned of a disqualification action under this section and to ensure a disqualified individual is prevented from assuming or continuing to hold public office.
To the extent practicable, consistent with the CPA's responsibilities and authorities, the Administrator should inform the public of his determinations and the bases for them.

Section 2: Existing Law #
Any laws or regulations inconsistent with the provisions of this Order are hereby suspended to the extent they are inconsistent with the provisions of this Order.
القسم 3: الدخول حيز التفاذ ومدة النفاذ #
يدخل هذا الأمر حيز النفاذ اعتباراً من تاريخ التوقيع عليه ويظل سارياً حتى يتم حل سلطة الائتلاف المؤقتة.

Section 3: Entry into Force and Duration #
This Order shall enter into force on the date of signature and shall remain in effect only until the CPA is dissolved.
