إعترافاً بالدور المركزي الذي تلعبه التجارة الدولية في إعمار العراق وتطوير نظام اقتصادي فيه يعتمد على السوق الحر ؛

Pursuant to my authority as Administrator of the Coalition Provisional Authority (CPA), and under the laws and usages of war, and consistent with relevant U.N. Security Council Resolutions, including Resolutions 1483 and 1511 (2003), Acknowledging the central role of international trade in Iraq's recovery and its development of a free market economy, Noting that the export of certain items, including certain metal products, is currently prohibited, Recognizing that the legitimate export of scrap metal is a potentially important source of income for Iraqi businesses, Emphasizing the need to control black-market activities while promoting opportunities for legitimate businesses, I hereby promulgate the following:

توفر هذه المذكرة القواعد المنظمة لتصدير المعادن الهالكة أو الخردة بموجب الأمر رقم 12 الصادر عن سلطة الائتلاف المؤقتة.
تعني عبارة "المعادن الهالكة أو الخردة" المواد المصنعة والمستخدمة كمنتج ما أو كجزء من منتج، ولكنها طُرحت جانباً بسبب عجزها عن توفير الفائدة المنشودة منها على نحو يواكب متطلبات العصر أو بسبب تعرضها للضرر أو للتلف.
Section 1: Purpose and Definition #
1) This Memorandum provides rules for the export of scrap under CPA Order Number
12.
2) "Scrap" is defined to mean material that has been finished and put to use as a product or part of a product, but has lost its intended usefulness as a result of obsolescence, damage or destruction.

CPA/MEM/25 January 2004/08 استثناء المعادن الهالكة أو الخردة من حظر التصدير لا تشمل البضائع والسلع المصنعة المحظور تصديرها بموجب نص الملحق المرفق بالأمر رقم 12 الصادر عن سلطة الائتلاف المؤقتة بتاريخ 7 حزيران/ يونيو 2003 مادة القيشاني الهالك أو المعادن الهالكة أو الخردة. ويُستثنى من ذلك النحاس والرصاص الذي يُحظر تصدير الهالك أو الخردة من أي منهما.
Section 2: Exclusion of Scrap as Prohibited Export #
The manufactured goods that are prohibited from export under the Annex to CPA Order Number 12 (CPA/ORDANNEX/7 June 2003/12) shall not include scrap ceramics or scrap metal, excluding copper and lead. Scrap copper and lead are prohibited exports.

القسم 3: التراخيص #
لا تصدّر المعادن من العراق، بما في ذلك المعادن الهالكة أو الخردة، بدون الحصول على ترخيص بذلك من وزارة التجارة. يسري هذا الحظر اعتباراً من اليوم الأول من شهر شباط/ فبراير 2004.
ويجوز تصدير المعادن الهالكة أو الخردة من العراق قبل هذا التاريخ بدون الحصول على ترخيص بذلك، باستثناء الهالك أو الخردة من النحاس والرصاص.
Section 3: Licenses #
Effective February 1, 2004, metal, including scrap metal, shall not be exported without authorization from the Ministry of Trade. Prior to February 1, 2004, scrap metal, excluding copper and lead, may be exported without a license.
